Terms and Conditions
1. Validity: Prices are valid for thirty (30) Days from the date of our proposal unless otherwise specifically modified in writing by us to meet specific customer needs.
2. Cancellation;Changes & Variations:
– a. No Order cancellation is acceptable to us as the package/s proposed is/are custom built.
– b. Changes made following receipt of an order may be subject to an adjustment for price towards extra expenses incurred, if any & on mutually agreeable terms.
– c. No terms, provisions or conditions at variance with those set out herein shall be effective in any way unless and until specifically accepted by us in writing.
3. GST: Our pricing does not include GST. Extra GST will be applied.
4. Delivery; Storage; Goods Receipt & Liquidated Damages:
– a. All deliveries will be completed within the period stated in our proposal from the date of receipt of your order at our end and subject to stock availability.
– b. Once built, packages will need to be despatched immediately.
– c. All goods are deemed to be delivered when they are handed over to client’s site contact and signed for as proof of having done so in good condition.
– d. Goods are to be inspected by the receiver and short supplies/damages, if any, will need to be brought to our attention immediately for making good.
– e. The delivery date is a bona fide estimate but we do not accept liability for late delivery. If liquidated damages are applicable for fixed delivery dates, confirmation in writing by us is required prior to acceptance of such a purchase order/s.
5. Payment:
– a. Prepaid or Net 30 Days #EOM (End of Month) provided this is expressly approved by us.
– b. All goods remain as our property until payment has been received in full by us.
– c. We may at its option and without notice charge interest on overdue accounts at a rate of 1% in excess of the maximum commercial prime lending rate currently in force and calculated from date of invoice to date of payment. Any payment from the customer shall be credited first against any interest so incurred.
6. Technical Data:
– a. Refer to ‘Specifications, Installation and Operating Instructions’ for further details.
– b. Data & Performance: All drawings and printed matter accompanying this communication or in the purchaser’s possession before or after acceptance of an order are informative only. Performance figures are based on our experience and are such as we expect to obtain on test. Liability will not be accepted unless these figures are specifically guaranteed in writing in which case they will be subject to the recognised tolerance and rejection limits applicable to such figures. The purchaser shall assume responsibility for the capacity and performance of the goods being sufficient and suitable for their purpose.
7. Warranty:
– a. New Equipment: All goods manufactured by us are warranted against faulty workmanship, materials or design for a period of twelve (12) months from the date of dispatch after which liability on our part ceases.
– b. Field Service: All field service works are warranted for a period of 90 days from the date of practical completion of service work after which liability on our part ceases.
– c. Warranty for free on-site replacement and repair of faulty components and/or workmanship within 30km of the Melbourne CBD.
– d. Due to our expertise and experience most problems when encountered are resolved very effectively and inexpensively by consulting us over the phone/email. Should a fault occur in a remote region or interstate, costs involved can become exorbitant. As a result of this and the low margins of our industry, we cannot offer anything other than the warranty as detailed below.
Outside 30km of the Melbourne CBD limits we will provide to the ‘Service Department of Customer’: i. Free consultation and ii. Free replacement faulty components (faulty components will need to be returned to our works).
Note: All equipment supplied by us are designed specifically for ease of maintenance and serviceability, with plug IN and OUT components utilised wherever possible to minimise down time and warranty issues.
– d. Except as otherwise may be provided by law our liability for any loss, injury or damage attributable thereto shall be limited to making good by exchange or repair of defective parts as detailed in Clause 9.d above.
– e. Except as may otherwise be provided by law we shall not be liable for any loss of profits or any other consequential loss or damage suffered by the purchaser in consequence of any defect in workmanship, material or design of the goods.
8. Precedence: In the event of conflict between these conditions and those, which may be included in, or implied by, any document forming part of any enquiry, specification, order or contract then these conditions shall prevail.
9. Installation:
– a. Where our contract includes installation or commissioning of plant on a purchaser’s premises our liability is limited to correct installation and proper operation of equipment supplied by us.
-b. We do not accept responsibility for the proper functioning of any equipment or services provided by others.
– c. If damage to our equipment is caused by others the cost of repairs will be to the purchaser’s account.
